Exploring the Ritch Report contempt of court standoff

This week we saw the dispute over the Ritch Immigration report between the Information Commissioner and the Office of the Premier come to a head. With the Premier issuing a ministerial certification of exemption blocking handing over the report and the ICO in turn writing to the Chief Justice to consider the failure to share the report a contempt of court.
Now this development is an unprecedented step on two levels. It’s the first time such a certificate was issued and the first time section 45 of the Freedom of Information Law will be tested in the court.
Attorney Richard Barton joined Tammi Sulliman on the couch to explore the ongoing tug of war and the legal implications.
