Data Protection laws ups demand for data controllers

Companies based here and operating in the U.K. or companies based in the U.K. and operating in Cayman will now have to hire data controllers to adhere to data protection laws for both jurisdictions.

Dean Lynee, Managing Director of Tri-Bridge Compliance, says the Data Protection laws contain reporting obligations which put the onus on companies to appoint data controllers in each respective region to fulfill those obligations.
A data controller determines the purposes, conditions and manner of which any personal data is or to be processed.

“Companies that are registered here in Cayman, but their doing a lot of their data controlling overseas, they need to then appoint a local person here as a data controller nominee and this person represents the company here on island,” said Mr. Lynee.
